services, and booking platform hosted under the trademark “Ethnic BNB”. By
accessing or using any Ethnic BNB services or listings, you agree to these Terms. Our system enables
users to search,
filter and book experiences, accommodations, ethnic stays, food types (veg,
non-veg, vegan, halal, Jain, kosher, lacto-vegetarian, gluten-free), language
preferences, local cultural relevance, and religious identity considerations
ONLY in the Search
& Finding Areas of our platform. Ethnic BNB respects global inclusivity,
but does not
discriminate or promote exclusion based on religion, ethnicity,

a cultural discovery & accommodation platform designed to connect travelers
with ethnic
stays, traditional food options, regional cuisines, authentic local communities,
tribal hospitality spaces, homestays rooted in heritage, and identity-based
travel preferences. Ethnic BNB is built
on principles of inclusivity, respect, transparency, food safety, lawful hosting, and
cultural authenticity. We allow search and filtering based
on: Ethnic BNB does NOT allow discrimination. These filters exist ONLY to search ethically,
not
for denial of service.2. What
Ethnic BNB Offers Ethnic BNB provides
one official
operating office (stated above) and acts as an online platform
that enables Hosts
to publish listings and Guests to search, filter, and book them. We do NOT own,
manage, or control the listed properties. We provide: ·A discovery-based cultural accommodation platform ·Verified host and experience listings ·Identity-friendly search system ·Standardized booking and communication tools ·Secure payment channel ·Transparent cancellation system ·Ethnic BNB Care Support Team We do not
provide: ·Real estate agency services ·Religious endorsement or political affiliation ·Travel visas, immigration consultation, or legal guarantees ·Employment or recruitment platform3.
Definitions For the purpose of
these Terms: ·“Member” – any registered user ·“Guest” – any user booking a stay ·“Host” – a person offering
accommodation or experience ·“Listing” – a published
accommodation/activity ·“Stay” – confirmed reservation ·“Common
Area”
– kitchen, prayer space, garden, etc. ·“Booking
Summary”
– charges, dates, policies ·“Ethnic
Search Tags” – cultural or dietary filters used ONLY for search results (NOT for
denial)4. Global
Ethnic Search Values Ethnic BNB allows identity-based discovery
respecting global values: 1. Respect all guests and hosts 2. No exclusion or superiority claims 3. Verified local representation 4. Traditional & indigenous protection norms 5. No hate, divisive messaging or profiling 6. Cultural preservation & tourism growth Search filters for religion, food, ethnicity,
and language exist ONLY to help users find relevant listings—not reject
anyone. Any host misusing such categories for exclusionary or
discriminatory action will be suspended or terminated.5.
Eligibility & User Responsibility To use our
platform, you confirm that: ·You are 18+ years of age ·You will act with honesty & cultural sensitivity ·You will not use false identity or illegal content ·You understand that Ethnic BNB is a mediator, not landlord ·You accept that hosts manage the property independently6.
Searching & Filtering (Identity-Friendly System) Ethnic BNB offers search filters
to help Guests find listings matching their comfort, dietary needs, linguistic
familiarity, local culture, ethnic immersion, or prayer requirements
— but never
to discriminate or deny a confirmed booking. IMPORTANT: These filters do not guarantee availability and cannot be used as a ground
for denial. They exist solely for guest comfort discovery.
All hosts must respect universal hospitality protocols. 6.1 Booking Process 1.Search → Filter preferences → Open Listing 2.Review Full Listing Details, Photos & Policies 3.Confirm Dates & Guest Count 4.Review Final Charges (the “Total Price”) 5.Make Payment → Booking Confirmation Issued 6.Contract Established directly between Guest &
Host After confirmation,
the Host
and Guest
are legally
bound under these Terms. Ethnic BNB acts only as a mediator. 6.2 Guest Responsibilities By booking an
Ethnic BNB Listing, You agree to: ·Respect local laws and house rules ·Not exceed permissible guest limit ·Treat all people equally—regardless of identity ·Avoid damage, noise pollution, or unsafe acts ·Notify host of allergies or dietary restrictions ·Avoid possession of illegal items or substances ·Pay for any damages reasonably proven If booking on behalf of minors,
you must: ·Be legally authorized as guardian ·Supervise at all times ·Disclose any medical or disability-related needs7. Booking
& Fees 7.1
Total Price Includes: ·Listing Price: The amount set directly by
the Host for the stay. ·EthnicBNB Service
Fee:
Covers platform operations, customer support, and related services. ·Local Taxes
(GST/VAT, etc.): Applied as per the laws and regulations of the respective region. ·Security Deposit
(if applicable): Fully refundable unless any damage or policy violation is reported. 7.2
Currency Conversion If You select a
currency different from host’s listing currency, the platform will convert
using Ethnic
BNB’s internal exchange rate. Converted rates are non-negotiable. 7.3
Booking Confirmation Once payment is
successful: ·You will receive a Booking Confirmation Email ·You will receive Host Contact Details ·Contract is legally binding ·Host may require legal ID verification Providing a fake identity or refusing to
submit valid identification after booking will be considered a legitimate
reason for the host to cancel the reservation.8.
Cancellations & Refunds All cancellations
follow the Category-Specific
Policies chosen by each Host and displayed BEFORE booking. Booking
Modifications Guest and Host may: 1) Change Dates 2) Modify Guest Count 3) Extend Stay 4) Revise Price Any modification
requires: ·Mutual consent ·Payment adjustment ·Written confirmation via platform ONLY (Outside negotiations are invalid.)9. Special
Cultural Accommodation Rules Guests must respect all religious and
cultural areas within the listing. Any violation of House Rules may
result in the host requesting a cancellation without refund, subject to a fair
review by the Ethnic BNB Care Team.10. Safety
& Emergency Legal Protocols Every Guest
Must Agree To: ·Immediately report any safety concerns or issues ·Provide and register a valid emergency contact ·Follow all fire, health, and evacuation guidelines ·Refrain from any criminal or suspicious activities ·Avoid all forms of discrimination or harassment Host must disclose reason
and report to Ethnic BNB care team after entry.11. Becoming
a Host To offer a Listing
on Ethnic BNB, You (“Host”) confirm that: ·You are 18+ years of age ·You have legal rights to permit stays or experiences ·You will comply with applicable tax, safety & cultural regulations ·You accept
Guests of all identities & backgrounds ·You will
not reject a confirmed Guest using religion/language/ethnicity/food type as a
reason Ethnic BNB may
request additional documents as required by law, including but not limited to food safety licenses,
local guest house permits, tribal tourism permits, heritage building use
certificate, income tax filings, municipal tourism approvals
etc.12. Listing
Standards Every published Listing must include: ·Accurate Listing Information: All descriptions must be truthful and free from
misleading or exaggerated details. ·Authentic Photos: Only real property photos are permitted. AI-generated
or stock images may be used only where explicitly allowed. ·Clear House Rules: All rules of the property must be clearly disclosed
before booking. ·Safety & Emergency Measures: Hosts must provide details such as fire exits,
first-aid availability, and emergency contact numbers. ·Cultural Sensitivity: Listings must respect local heritage, traditions, and
cultural norms. ·Transparent Cancellation Policy: The cancellation terms must be clearly explained to
guests. ·Food & Menu Details: All food offerings must include accurate ingredient
and allergen information. ·Identity-Friendly Tags: Tags related to identity or preferences may be used only for search
convenience, not for rejecting
bookings. Host must truthfully represent: ·Type of property
(home, guesthouse, tribal-stay, cottage etc.) ·Food offered OR
cooking rights ·Availability of
prayer/meditation area (if listed) ·Cultural
observance periods (e.g. fasting month, harvest festival, tribal ceremonial
days).13.
Language, Cultural & Religious Considerations in Listings Hosts may mention available
facilities, but may not refuse guests based on identity. "Identity may
be filtered ONLY for discovery, NEVER for denial."14.
Authenticity & Local Representation Ethnic BNB promotes
ethical tourism. Hosts Confirm: ·Local traditions will not be falsely commercialized ·Indigenous communities will not be exploited ·Guests will be informed of customs respectfully ·Photography (if restricted) must be disclosed clearly ·Cultural activities are optional — never forced15. Host
Tax, Insurance & Documentation 15.1
Host Tax Responsibilities Hosts are
responsible for their own: ·GST/VAT/Service Tax (when applicable) ·Income declaration as per region ·Professional tax (if commercial operations involved) ·Registration in local tourism directory (where required) Ethnic BNB may deduct applicable taxes as
per law and issue statements for accounting via
registered email. 15.2
Host Insurance Hosts must clearly
disclose if property has: ·Accident coverage ·Damage protection ·Travel health insurance (if third-party service) ·Natural disaster coverage No guarantee is provided by Ethnic BNB unless
explicitly stated in writing. 15.3
Host May NOT Do 1) Read guest
private messages 2) Enter room without lawful cause 3) Record audio/video of guests secretly 4) Sell guest information to third parties 5) Use identity filters to refuse booking Any violation may
result in: suspension,
legal notice, removal from platform, and disclosure to authorities,
when mandatory.16. Content
& Intellectual Property All materials on
Ethnic BNB — including but not limited to text content, logos, photographs, videos,
documents, listing formats, booking structures, search algorithmic behavior,
ethnic filters & category frameworks — are owned by: Ethnic BNB - An enterprise of New Zealand
Fresh & Natural (India) Pvt. Ltd. Unless explicitly
stated otherwise, all rights are reserved, and no copying, reverse
engineering, training of AI models, resale, scraping, or redistribution
may occur without prior written and timestamped consent from the company. 16.1
License to Guests & Hosts By using the
platform, you receive a non-exclusive, revocable, non-transferable right to access it solely for
personal, lawful and hospitality-related purposes. 16.2
Prohibited Content You may NOT
upload: ·Hateful, discriminatory, or identity-abusing text ·Adult or explicit material ·False representation / impersonation ·Political campaign or propaganda ·Links to viruses, scams or malicious pages ·AI-generated false property photos ·Misleading ethnic claims or fabricated traditions Violations will
lead to: Immediate
removal of listing / profile, possible legal action, and data sharing with
relevant law enforcement (if warranted).17.
Payment, Charges & Currency 17.1
Payment Methods Payments are
processed through secure gateways including: ·Debit/Credit Cards ·UPI & Bank Transfers ·PayPal 17.2
Ethnic BNB Service Charge A service fee
is applied per booking based on: ·Listing region ·Risk factor ·Payment processing cost ·Support expense ·Tax as mandated 17.3
Invoice Policy An invoice is
automatically generated and emailed to: 1) The Guest 2) The Host 3) Ethnic BNB Internal Compliance Archive All invoice data
must remain accurate for legal verification. 17.4
Currency Conversion Standard Ethnic BNB applies
its own
real-time adjusted internal exchange rate. External forex market fluctuations do not guarantee booking changes after confirmation. All amounts paid are final and non-negotiable unless booking policies apply.18.
Prohibited Conduct No user shall —
directly or indirectly: ·Demand host to hide income or taxes ·Sell rooms or re-list them elsewhere without permission ·Use religion/ethnicity/language to refuse confirmed guests ·Force cultural or religious participation ·Enter into political activism using Ethnic BNB tools ·Host any illegal gathering or contraband ·Create duplicate accounts to manipulate ratings ·Upload pirated images or copyrighted text ·Use automated scraping/bot systems on Ethnic BNB Usage of extremist, separatist, or
identity-exclusionary messaging will lead to permanent ban and possible legal
action under applicable jurisdiction.19. Reviews
& Community Standards After stay
completion, both Host and Guest may leave reviews, ratings & feedback. Removal
of Content Ethnic BNB may
remove any review that: ·Includes hate speech or profiling ·Contains fake claims to damage reputation ·Reveals personal data (phone, ID, religion etc.) ·Is posted by a competitor to bias the market ·Contains political, ideological or religious attacks Reviews may be used to improve
host training or platform moderation but cannot be edited by request except
under legal proof of error.20.
Termination & Suspension 20.1
Expulsion (Permanent) Ethnic BNB reserves
the right to BAN user permanently if they are proven guilty of: Actions & Responses Selling or misusing guest data: Legal action will be taken, and the account will be permanently removed. Knowingly violating safety or fire regulations: An FIR or legal complaint may be filed against the account holder. Cultural exploitation or misuse of tribal
heritage: Strict legal enforcement and action will be initiated against the account. Listing a false address or using stolen images: The listing and the associated account will be terminated immediately. 20.2
Data Retention Upon Termination Upon
suspension/termination: ·All messages & bookings may be archived ·User may request export of own booking data (where legal) ·Ethnic BNB may retain user identity for regulatory compliance 20.3
Reinstatement A suspended Host/Guest
may apply for reinstatement by: 1.Submitting a formal written
explanation 2.Providing supporting
documents 3.Attending compliance
interview (if needed) Approval is
entirely at Ethnic BNB’s discretion.21.
Liability & Indemnification 21.1
Platform Limitation Ethnic BNB operates
only as a
digital mediator between Guest and Host. We do not own, operate, manage,
guarantee, insure, license, or supervise any property listed on
the platform — unless officially stated in writing by the company. All bookings,
payments, risks, and liabilities exist directly between Guest and Host,
and all
local laws apply without limitation. 21.2
Liability Disclaimer Ethnic BNB shall not be
liable for: ·Injuries, accidents, or property damage during stay ·Loss of personal items or theft ·Host’s misconduct or negligence ·Natural disasters affecting booking ·Cultural misinterpretation or host-guest disputes ·Incorrect user-declared information ·Visa, immigration, or travel legality issues We provide assistance only,
and not
legal defense. 21.3
Host Indemnification Host indemnifies
Ethnic BNB if they: ·Host illegally without permits ·Ignore food safety or hygiene norms ·Delete or falsify registration records ·Discriminate using ethnic/religious filters ·Violate building/fire regulations ·Mislead Guests in description or visual content Any verified
complaint may be forwarded to regulatory bodies or legal enforcement.22. Dispute
Resolution 22.1
Hierarchy of Resolution All disputes must
follow: Dispute Resolution Process Initiate direct communication
between the Guest and Host to resolve the issue amicably. Reach out to the EthnicBNB Care Team for
assistance if the matter remains unresolved. Submit a written complaint
from your registered email address for formal review. Proceed with third-party mediation, if
recommended by the EthnicBNB Care Team. Consider legal action only as a final option,
after all other steps have been exhausted. 22.2
Non-Litigation Policy Ethnic BNB
encourages amicable
solutions to preserve community dignity and avoid unnecessary
legal escalation. Litigation is
permitted only after the above channels have been exhausted.23.
Jurisdiction & Governing Law This Terms of
Service is legally
governed by: The Laws of India Specific
Jurisdiction: Kolkata, West Bengal Any legal
proceeding must be filed exclusively in the competent court located in Kolkata, India. No other city or international jurisdiction
applies,
unless Ethnic BNB formally extends local operating offices in the future. As of
2025 — we proudly operate from: One and Only
Official Office 6 Waterloo Street, Suite-101,
Kolkata, 700069, India24. Force
Majeure Ethnic BNB, Host,
or Guest cannot be held liable for failure to perform obligations during events
including but not limited to: In such conditions: ·Pending bookings may be rescheduled or refunded depending on Host’s
capacity and official notifications. ·Ethnic BNB may declare temporary suspension of platform functionality. ·Emergency protocols will be updated via official website or email to
affected users.25. Final
Acceptance By using Ethnic BNB
services, platform, sites, communication tools, listings, or booking channels —
You officially confirm that: 1) You have read,
understood and accepted these Terms of Service 2) You agree to all identity-friendly but non-discriminatory rules 3) You understand that Ethnic BNB does not guarantee any property 4) You agree to resolve disputes with dignity via formal channels 5) You accept Indian Law as the legal governing framework 6) You shall NOT
misuse food/religion/ethnicity filters to reject confirmed guestsDECLARATION
